Preamble
These conditions are concluded between, on the one hand, the S.A. under Belgian law Eurofoodmat, located on Rue de la Cale Dry, 34 - 4684 Haccourt - RPM-TVA: BE 0476 778 952, the following referred to as "Colichef" and on the other hand, those wishing to make a purchase via our website http://www.colichef.fr below referred to as "User."
The shipment of parcels will only be possible in all the countries of the European Union, plus Switzerland.
The User who would like to buy on Colichef, declares that he has full legal capacity. Any person who is incapacitated, in particular under section 1123 and following the Civil Code, cannot in any way buy on Colichef. The consultation of the site Colichef and the services it offers are then the responsibility of its legal representative. This legal representative is required to comply with these stipulations. In any event, when transmitting personal data, the legal representative will have to compile the registration form himself or expressly authorize the person he represents to complete that form, the stipulations relating to personal data as provided for in article 8 below, of course applying.
The parties agree that their relationship will be governed exclusively by this contract, excluding any conditions previously available on the site.
If a condition were to fail, it would be considered to be governed by the practices in force in the distance selling sector of which the companies are based in Belgium.
The order is honored subject to the faculty to Colichef to refuse it. In particular, an order may not be honoured in the event of a price indication error, the absence of a settlement of previous purchases or in the event of returns or losses of items deemed too frequent by Colichef.
Any order for a product offered on the Site requires the consultation and express acceptance of these terms and conditions of sale, but this acceptance is not conditional on a handwritten signature on the part of the User. In accordance with the provisions of the law of 9 July 2001 setting out certain rules relating to the legal framework for electronic signatures and certification services, it is recalled that the validation of the purchase order as specified in Article 3.3. below is an electronic signature which, between the Parties, has the same value as a handwritten signature and is worth proof of the entire order and the duery of the sums owed in the execution of that order.
ARTICLE 1: OBJECT
These conditions apply to online sales on European territory. They aim to define the terms of sale between Colichef and the User, from order to services, through payment and delivery.
They regulate all the steps necessary to place the order and follow up on this order between the contracting parties.
ARTICLE 2: PRICE
Prices are shown in Euro and are valid for Europe. These prices are mentioned in EURO all taxes included (VAT 21%), and excluding delivery fees (see ARTICLE 5).
Colichef reserves the right to change its prices at any time but the products will be charged on the basis of the rates in effect at the time of the validation of the order.
ARTICLE 3: ORDER
The user has the option to place his order online:
- either from the site's references
- either directly from the references in the Colichef paper catalogue (the latest rates of the site are given priority over the prices of the catalogues).
Colichef undertakes to honour orders received on the website www.colichef.fr only within the limits of available product stocks. If the item is sold out, Colichef may have to deliver an item similar to equivalent or superior and at an equivalent price.
ARTICLE 4: PAYMENT METHODS
In order to offer you the lowest prices and the best service, the payment must reach us at the same time as your order or at the latest during delivery.
For your order to be validated, you must choose one of the following payment methods:
A) BY CREDIT CARD
The User transmits his Visa or Mastercard card number, the expiry date of the visa card and the cryptogram number (three-digit number on the back of the credit card).
Colichef ensures that payment is secured by S.S.L. (Secure Socket Layer) encryption in order to protect all payment-related data as effectively as possible. Colichef works with Paybox and CIC Bank for online payments.
B) BY BANK TRANSFER BEFORE DELIVERY
No goods will be issued if Colichef has not cashed the order amount.
Payments by bank transfer must be made to our next bank account with your order number in contact:

If the invoice is not paid or the invoice is late at maturity, all debts to Colichef become due as of right.
The amount due will be increased by right and without prior notice of conventional interest up to 2% per month as well as a lump sum payment of 15% with a minimum of 80 euros.
The debtor is also required to pay all collection costs, both judicial and extrajudicial, to which the recovery of an unpaid invoice will result. Extrajudicial cashing fees are set in lump sums at an amount equal to 15% of the total amount owed, with a minimum of 120 euros.
C) BY PAYPAL
Once connected to their paypal account, the user pays for his order via his paypal account (provided it is sufficiently supplied)
D) BY INTERNET TRANSFER
Users can also pay for their order via netbanking (Card, Blue, Ing Home Pay, CBC...)
The products remain the property of Colichef until the full payment of the price.
ARTICLE 5: DELIVERY
As soon as your payment method is validated, Colichef prepare your order for shipping.
A) DELAYS
For all items available in stock, the following shipping times and charges apply
For delivery to France, Belgium or Luxembourg, the deadlines after shipment are 24/48 hours. These deadlines are provided as an indication and not as a contractual one. In 98% of cases, UPS meets these deadlines and delivers within 24/48 hours.
For parcel withdrawals at delivery points, an existing ID is required. Otherwise, the products ordered cannot be delivered.
Your parcel is kept for 10 days at the relay point, then it is returned to us. If we return to our warehouses.
For some remote or hard-to-reach areas (mountain, island, Corsica,...) additional charges may be charged by our carrier. These transportation costs will be borne by the buyer. Colichef undertakes to notify the buyer before shipping if additional charges are charged. In this case, the buyer can choose to take charge of the supplement or request the cancellation and refund of his order.
B) RESERVES
You must notify the carrier and Customer Service Colichef any reservations about the product delivered (example: damaged parcel, parcel already open...).
Any delivery problems (missing or damaged) must be reported to us promptly (within 48 hours) on 0033 (0)2 78840191. The corresponding returned item must then arrive to us within 14 days of receipt by requesting the exchange or refund.
ARTICLE 6: RETRACTATION
The User has a 100-day timetable, from the day of delivery of the products, to return at his own expense and under his responsibility, the new product (s) that he has ordered.
The product (s) must be returned in its packaging and its original packaging at the following address:

Not taken up by Colichef:
- Damaged, incomplete, soiled, improperly unpacked or used items cannot be returned.
- Gift vouchers Colichef
- Items damaged by negligence, misuse or repaired by third parties or by the user himself
- Books and electrical equipment (household appliances) opened or used
- Items that follow a personal or special order
- Custom items (e.g. engraved knives, engraved siphons)
- Items that may deteriorate or perish
In case of abusive returns, Colichef reserves the right to refuse a subsequent order.
If the right of withdrawal is exercised within the aforementioned time frame, Colichef will refund the user, within 30 days of the date of receipt of the parcel by Colichef. The sums paid by him, except however the return and delivery costs of the products that remain at the expense of the User.
In the case of an exchange order, the new processing and transport costs will be borne by the user.
In the case of a first order paid in several times (3x at no cost per cheque), the items can be taken back in accordance with the above conditions but the customer will only benefit from a voucher to be valued on a next order and not a refund of the returned product.
In the event of a refund, Colichef will refund items that have been properly returned and meet the above conditions. Shipping and return costs will not be refunded. In the event that the initial delivery costs were borne by Colichef (ordering an amount entitling to a "free port fee" delivery or in case of promotion) these fees are deducted from the amount refunded to the customer.
Note: Some products such as books and electrical equipment may be protected by an additional protective film or blue strap confirming that the product has not been opened and/or used. Books and electrical equipment that no longer have these protections will not be able to be taken back.
If an item returned by the customer is considered to be non-compliant with the terms of the resumption and therefore not taken over, Colichef undertakes to contact the customer to inform him that his item will not be refunded. The customer can then choose to abandon his product at Colichef or decide that his product himself returned but at his own expense.
In the event of a product exchange, the shipping costs of the new products will be borne by the customer.
ARTICLE 7: MINIMUM 2-YEAR GUARANTEE
Even if the manufacturer's traditional warranty is one year, Colichef offers you an additional year's warranty, a minimum of two years. Sometimes the warranty is higher, in which case the warranty is specified in the description of the article.
Our goods are guaranteed from the billing date against any manufacturing defects. The invoice issued with the reference of the ordered item is a guarantee and must be attached in case of return of the item.
The warranty does not play for apparent defects. Also excluded are defects and deteriorations caused by natural wear, an external accident, negligence, improper use or a maintenance defect. Books are only guaranteed for one year.
Colichef will only be able to take back products located in Belgium and metropolitan France. Guaranteed shipments will also only take place in Belgium or metropolitan France. Shipping and return costs are the buyer's responsibility. For some items, the return and shipping costs are covered by Colichef, in which case it is specified in the description of the article.
ARTICLE 8: PRIVACY
The information that is requested from the User is necessary to process his order, and can be communicated to the company's contractual partners (accountants, lawyers, etc.).
They may also be passed on to any authority responsible for resolving disputes between Colichef and one of the Users.
In accordance with the Privacy Act of December 8, 1992 with respect to personal data processing, you have the right to access and correct this data at all times, as well as the right to object if you no longer wish to be informed of our activities.
All personal data is intended for the internal use of Colichef
ARTICLE 9: INTELLECTUAL PROPERTY
All the building blocks of the site's skeleton (photos, images, logos, flash animations®, modelled elements, etc.), as well as technological elements (software creations, back-office administration, proposed services, etc.) are protected by copyright and are the exclusive property of their respective authors, except in the limited cases of full or partial transfer of rights in favour of Colichef.
The contents of the site (texts, articles, etc.) are the exclusive property of their authors and cannot be reproduced or exploited without their consent. Colichef only allows the reproduction of excerpts from its articles via the RSS feeds present on its sites. In accordance with the provisions of the Intellectual Property Code, any reproduction of partial or total content of the site is prohibited, whatever its form (reproduction, nesting, dissemination, techniques of "inline linking" and "framing" ...).
Direct links to downloadable files (regardless of their format) on our site are also prohibited.
If you wish to establish a link with our site, and before any implementation of it, please contact Colichef before any link to our site or its content is put in place.
The texts present from external sources were reproduced with the implicit or explicit agreement of their respective authors. As such, mention is made on the website of the respective sources and authors.
Despite our vigilance, some photos or images may be different from the actual product. Under no circumstances, the photos are contractual.
ARTICLE 10: FORCE MAJEURE
Colichef will not be responsible for the complete or partial non-performance of its obligations under this contract, if this non-performance is caused by a force majeure event, including the presence of computer viruses, computer bug, display problem, problem of calculating discounts, in case of disruption or total or partial strike including postal services and means of transport and/or communications, flooding, fire.
Events that meet the criteria set out in the case law will be considered as a case of force majeure.
In the presence of a force majeure event, Colichef will notify the User within five (5) working days of the occurrence of this event.
After a period of one (1) month's interruption due to force majeure, Colichef may not honour the order, it may not be responsible for repaying the Buyer if necessary.
ARTICLE 11: NULLITE
If one or more stipulations of these terms and conditions of sale are considered invalid or declared invalid under a law, regulation or final decision of a competent court, the other stipulations will retain all their strength and scope.
ARTICLE 12: APPLICABLE LAW
These terms and conditions are subject to Belgian law. In the event of a dispute, Belgian law is applicable and only the courts of the judicial district of Liège have jurisdiction.
